TO THE HONORABLE MEMBERS OF THE UNITED STATES SENATE
THE FUTURE OF THE AMERICAN DREAM HANGS IN THE BALANCE WAITING FOR YOUR ACTION TO SOLVE THE CRITICALLY IMPORTANT CHALLENGES OF IMMIGRATION.
Most Informed American Citizens know today that our Immigration System is broken.
Like a puzzle, the System has many pieces. These pieces no longer fit together.
The System is: cumbersome, conflicted, incomplete, and non-enforceable.
THE REALITY CHECK
What to do about it?
It appears unlikely that the United States Senate will reach agreement on a New Immigration Bill anytime soon!
Americans expect and deserve a Comprehensive Solution.
The problem will NOT go away. It will only get LARGER every day.
The media has now sensitized the American Public. The Public is beginning to react emotionally. The extent and direction of these emotions cannot be anticipated with any degree of certainty.
THEREFORE, NO ACTION IS THE WRONG OPTION!
We made it to the MOON!
Certainly we can fix our Immigration Problems!
THE CHALLENGE IS:
Large, Extensive, and Complex.
Critically important to the survival of our Nation.
Immigration must be fixed and fixed NOW!
TIME OUT
Take a Time Out!
Go back to The Drawing Board.
Immigration Problems did not appear Over Night nor will they go away Over Night.
The future of Our Nation is at stake. Special Attention is Mandatory!
Let Us All Take Responsibility!
You are our Elected Representatives. It is your responsibility, along with the President,to direct a solution and solvee, with the Publics imput, these complex problems NOW!
We need to create an Immigration Reform Commission.
A Commission Chartered to Draft a:
New Comprehensive Turnkey Immigration Bill.
YES, it will take a longer than you expected to complete the job.
But Let's Get It Right! Not Just Get it Done!
THE PROBLEM
The present Immigration Law has undergone minimal change since the 1980's.
There are limited Review and Sunset Provisions.
The Immigration Code meanwhile has mushroomed. It is now the 2nd largest Federal Code second only to the I.R.S. Code in size and complexity.
The Law and Code are far too large, extensive, and complex to expect the current approach of Congress to succeed. At best we are patching up the Law with little understanding of the interrelationships.
The present Law is cumbersome, complicated, and conflicted.
Those responsible for administering the LAW and CODE cannot possibly Connect All the Dots to make it work efficiently.
THE SOLUTION
Build a New System for Immigration that:
Is responsive, flexible, and resilient to changing times, conditions, and individual needs.
Uses a common language (English), but accommodate a wide spectrum of languages.
Utilize Technology: systems, tools, and databases that are seamless and able to be updated as the System needs evolve.
Is as simplistic as possible. (KISS)
The Information Age:
Gives us the opportunity to keep track of and control the Total System
Allows us to achieve the proper interfaces at and between all levels of Government and the Private Sector.
THE GOAL
Create a NEW TURNKEY IMMIGRATION LAW:
Congress is to authorize, in similar fashion to the Immigration Reform Commission of the mid 1990's, a New Commission.
This New Commission will be:
Made up of the best minds in our country and around the world
Represent all points of view and disciplines
Profit from those who have gone before us
Forge a Draft Bill that will be presented to both Houses of Congress.
Be charged to look at the Old Law as:
A "Broken Puzzle."
Take apart, the pieces, clean, throw away, or replace the old pieces with new ones.
Reassemble the New Puzzle Pieces into a seamless, efficient, and enforceable New Bill that will look like a Beautiful Tapestry!
Congress will be mandated to act in a timely fashion on The Bill the Commission fashions.
NO OTHER BILL will be substituted for consideration.
Congress agrees to provide for passage of the Draft Bill, as presented by the Commission, with proper consideration and amendment; or agrees to follow the procedure of the Base Realignment and Closing Commission (BRAC) or the Trade Agreement Fast Track Authority.
Major Technical System changes should be reported out of the Commission for Congressional and Presidential approval as soon as possible.
Establishing an efficient timetable for implementation of the New Law is critical:
For realistic scheduling
To gain and maintain an optimistic positive attitude and belief on the part of the American Public that not only will the New System come to fruition, but also that IT WILL WORK!
Congress and the Commission should work closely together to implement major early changes and not wait for the Final Turnkey System.
TIMING:
The Commission will begin work no later than July 1, 2006.
The final New Comprehensive Turn-Key Immigration Bill should be signed into law no later than the end of the 2007-2008 Congressional Session.
The New System will have its Turn-Key Implementation no later than 2010!
BEFORE CONCLUDING:
You may have noticed that there are no Specific Recommendations in this letter except those connected to the New System itself.
That does not mean that I am without solutions. As one with incredible passion on this topic I will not leave without crossing the threshold into the New Tapestry Lined Room .
In my mind, heart, and soul, I am convinced:
The Basic Solutions Lie before us TODAY!
Here are some of my ideas:
• BLUE CARD REGISTRATION: Illegal Alien Registration with NO Criminal Record or Deportation, giving all Illegal Aliens the opportunity to be legal and get on the magnificent path to American Citizenship.
• REPEAL A LAW: The Emergency Medical Treatment and Active Labor Act of 1985.
• PASS A LAW: Babies born to illegal aliens will no longer have American Citizenship Rights until they are earned.
• OBTAIN A RULING: FROM THE UNITED STATE SUPREME COURT REGARDING THE APPLICATION OF THE 14 TH AMENDMENT OF THE CONSTITUTION TO CITIZENSHIP OF CHILDREN BORN TO ILLEGAL ALIENS
• The 14th Amendment was specifically limited in scope to the Post-Civil War period allowing for the immediate franchising of slaves.
• NO AMNESTY
ENFORCE THE LAWS OF THE LAND
WORK WITH OUR NEIGHBORS TO DEVELOP BETTER LONG TERM ENVIRONMENTS SO PEOPLE WILL WANT TO REMAIN IN THEIR HOMELANDS!
IN CONCLUSION
Now wasn't that EASY?
Isn't it really COMMON SENSE?
So let us begin today!
